Rental Terms and Conditions

 

General Rules for use of iParty and Bounce inflatable units and Soft-Play Set Up:

• Only compatible age groups and sizes shall play in the iParty and Bounce unit or Soft-Play Set up at the same time.

• If set up is outside, area MUST be cleared of all dog feces. We have the right to refuse set-up if area is not cleared prior to arrival.

• Do not exceed the weight limit on the inflatable units. This can put stress on the seams.

• No children over the age of 5 are to play on iParty and Bounce's Soft-Play Set up.

• Children should not lay down in the inflatable while others are bouncing to prevent injury.

• Slides are meant for no more than 1 rider at a time.

• All riders must remove their shoes before playing on the iParty and Bounce inflatable unit's or Soft-Play Setup.

• No glasses, jewelry, or sharp objects should be on or near the iParty and Bounce inflatable unit or Soft-Play Set up.

• Please ensure that children are not attempting somersaults or flips to avoid neck or back injury.

• Do not run and/or bounce against the walls of inflatable. Do not run or jump through the entrance of the inflatable. Do not climb or hang from the interior of exterior of the inflatable.

• No water play allowed unless renting a water slide specifically for wet use.

• Absolutely NO food, drinks, candy, gum, silly string, confetti, confetti eggs, party poppers, face paints, fireworks or color streamers are to be on or around the inflatable or Soft-Play Setup. These can cause damage and could result in a $500.00 cleaning fee up to paying for a replacement of iParty and Bounce units.

• Do Not Move iParty and Bounce's inflatable unit or Soft-Play Setup from the place where it is installed. It is important that the person on site knows where the inflatable needs to be installed. Our inflatable units and/or soft play can only be set up and moved by our trained employees.

• No pets inside iParty and Bounce inflatable units or Soft-Play Set up.

• If winds exceed 15 mph remove all occupants and deflate the bounce house. Once the wind dies down you can turn the blower back on and continue to use the inflatable.

• Do not use the inflatable or Soft-Play Setup during the rain. The jump surface can become very slippery when wet.

• If it rains during your party, there is NO REFUND.

• When using a generator, if unit begins to deflate, remove all occupants quickly, check the gas gauge to ensure there is adequate amount of gas to run properly. Please note that we provide a full tank of gas at drop off. Lessee will be responsible for gas once it runs out.

• Should a inflatable unit begin to deflate, immediately remove all occupants quickly. Then check the following: 1) The connection at the outlet near the motor and the extension cord (10 or 12 gauge) plugged directly into the outlet is still plugged in. 2) If the motor is continuing to run, check the air intake on the side of the motor for blockage and check both tubes at the back of the unit for snugness, re-tie if necessary. 3) Check the breaker. 4) If you cannot correct the problem, please call us at 512-466-9412

• Children's safety depends on you. Your personal supervision is absolutely required. Supervisor must be at least 18 years of age and be present at ALL times. As the Lessee of iParty and Bounce unit and or Soft-Play Setup, the safety of ALL riders is your responsibility.

• If at any time during your rental adult supervision cannot be provided, please turn the inflatable off and close gates until such time that adult supervision can be provided as required.

• If these general rules are not followed it could result in additional fees.

Safety Operation Acknowledgement:

Lessee acknowledges that he/she has been instructed about and fully understands the safety operation of the iParty and Bounce inflatable units and/or soft play and Lessee agrees to observe All safety precautions.

Release of Liability:

• The lessee shall be in charge of the iParty and Bounce inflatable unit's and/or Soft-Play Setup's operation and is fully responsible for operation after receiving the units. Lessor is not responsible for injuries occurring to Lessees or to the persons using the leased property. In the event that the release and hold harmless as contained herein is held unenforceable for any reason, lessee hereby agrees to limit on any damages claimed by lessee to the total paid to iParty and Bounce for the rental.

• ​Lessee understands and acknowledges that play on an amusement device entails both known and unknown risks including, but not limited to, physical injury from falling, slipping, crashing or colliding, emotional injury, paralysis, distress, damage or death to any participant. Lessee agrees to indemnify and hold iParty and Bounce harmless from any and all claims, actions, suits, proceedings, costs, expenses, fees, damages and liabilities, including, but not limited to, reasonable attorney’s fees and costs, arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of the leased equipment. This includes, but is not limited to, the manufacture, selection, delivery, possession, use, operation, or return of the equipment. Lessee hereby releases and holds harmless iParty and Bounce from injuries or damages incurred as a result of the use of the leased equipment. iParty and Bounce cannot, under any circumstances, be held liable for injuries as a result of inappropriate use, God, nature, or other conditions beyond its control or knowledge. Lessee also agrees to indemnify and hold harmless iParty and Bounce from any loss, damage, theft or destruction of the equipment during the term of the lease and any extensions thereof.

• The Lessee understands and acknowledges that the activity to be engaged in through my rental of inflatable amusement equipment such as bounce houses, inflatable slides, bounce house combos, and/or other party rental equipment, brings both known and unanticipated risks to its guest and invitees and itself. Those risks include, but are not limited to falling, slipping, crashing, and colliding which could result in injury, illness, disease, emotional distress, death, and/or property damage to myself or my guest and invitees. I for myself and for all my participants, guest, and invites, including minors, willingly assume the risks associated with all participation and accept that there are other risks that may arise due to other participants which I also willingly assume.

• The lessee acknowledges and represents that it has adequate homeowners' insurance, tenant insurance, or other liability insurance to cover any bodily injury or property damage which may occur to itself, its guest, or its invitees from the use of the equipment being rented, or leased Lessee agrees to bear the cost of defense and liability of any such injury or damage itself. The lessee also waives the right of its insurance company to bring any type of action or proceeding on behalf of the Lessee against iParty and Bounce whether by assignment of claim, subrogation, or otherwise.

• Delivery shall be to the address specified by the Lessee. Lessee agrees to allow iParty and Bounce to enter premises of lessee at any time to repossess said equipment.

• Lessee agrees to reimburse iParty and Bounce for all attorney fees, an amount not less than 75% of all sums due, court cost and expenses incurred by iParty and Bounce to enforce collection or to preserve or enforce rights under this contract.

• Lessee agrees Not to loan, sublet, or otherwise depose of inflatable and/or soft-play equipment or use it at any other location.

• Lessee agrees to pay in full the replacement cost, including labor, for all damages to rental equipment.

• If the inflatable or soft-play set up is lost, stolen, or damaged beyond repair, the lessee agrees to pay up to $6000.00.

• There are No warranties of merchant ability or fitness either expressed or implied.

• iParty and Bounce reserves the right to cancel a rental due to unsafe weather conditions.

• Overnight Rentals: Lessee understands and acknowledges that the inflatable and/or soft play set up must be in a secure, fenced backyard with NO pets. The blower is to be removed and locked in a secure location overnight while not in use.

• The lessee must mark any underground lines (water, gas, sprinklers, ect). iParty and Bounce is NOT responsible for hitting a line when staking.

• 25% deposit is required to secure rental.

• 25% deposit is nonrefundable.

• Full Payment must be made before rental is setup.

• An adult over the age of 18 must be present during setup.

The person(s) or organization renting this equipment from iParty and Bounce will be held responsible and liable for any and all damages or injury occurring for any reason what soever. I have read the above agreement and fully understand and accept the terms and conditions as above. I am aware that while in my possession I am fully responsible for the iParty and Bounce unit or equipment and will pay for any loss or damages that may occur.
